Set of Car Keys

Every year in the state of Tennessee, thousands of people are injured by the negligence of others. Making the decision to drink and drive is not only dangerous, but it could be very costly should you choose to do so. Almost 20% of all traffic related deaths have been linked to drivers under the influence.

Being accused of DWI (driving while intoxicated) or DUI (driving under the influence) can have devastating consequences. Depending on the exact circumstances of the case, you can be facing exorbitant insurance payments, the loss of your license, or even time in jail.

In Knoxville, and across Tennessee, it is against the law to operate a motor vehicle under the influence of drugs, alcohol, and any substance affecting the central nervous system. If you have a blood alcohol concentration of 0.08% or more, you may be charged with a DUI or DWI. If you are operating a commercial vehicle and have a blood alcohol concentration of 0.04% or more, you may also be charged with a DUI or DWI.

If you have been arrested on a DUI or DWI charge, Robert L. Jolley, Jr is ready to help. Whether you are the victim of a DWI or DUI case or you have just been charged, he will guide you through the legal process, making this challenging time a little less stressful. Robert can help navigate you through the courtroom proceedings and provide you with the legal representation you are looking for.

You May Face Serious Consequences Without Our DWI Attorney

Just because you have been pulled over, does not mean that you will be arrested. The police officer is required to have probable cause, which is evidence of the crime. This is when most officers give sobriety tests and breathalyzers.

In the state of Tennessee, driving over the legal limit includes having a blood alcohol concentration over 0.08%. If you are driving and get pulled over in Knoxville or other Tennessee areas, and are asked to complete a chemical test, you must take it. If not, you could automatically lose your license. Your license could be suspended for 1 -5 years depending on the offense that was committed.

Knoxville, TN and the rest of the state imposes heavy penalties on DWI and DUI charges. Other than facing a suspended license, you many also have to face criminal charges in court, as well as jail time depending on your offense.
An ignition interlock device may also need to be installed on your vehicle after your license is reinstated, which would require you to take a breathalyzer before starting the vehicle. These systems are paid out of your pocket and can be quiet expensive. Most devices cost $150 to install, $75 to remove, and about $100 per month for maintenance and monitoring.

When you are allowed to reinstate your license, this may also result in a hefty fee.

Good People Make Mistakes – And So Do Police Officers

Any good drunk driving attorney knows that fighting the charges means finding the mistakes in the case. Whether you made the mistake or the police officers handling the case did, we will make sure we gain a complete and unbiased picture of what happened. If the police officers who pulled you over or examined you erred in processing or obtaining the evidence, we can use that to get your charges reduced or even thrown out. We can also use the circumstances of your life to persuade the judge or prosecuting attorney to practice leniency.

Though you may have initially made the mistake of choosing to operate a vehicle while under the influence, there can be factors that will lessen the consequences. However, the first and best choice should be choosing NOT to drive while intoxicated or under the influence of drugs.
